What to Do If You're Arrested in Dublin: Your Rights and Next Steps

Being arrested can be one of the most stressful experiences in a person’s life. Whether it's your first time in trouble with the law or you've been through the system before, understanding your rights and options is crucial. At Michael J. Staines & Company, we’ve advised and defended thousands of clients facing criminal charges in Dublin and across Ireland. Here's what you need to know if you're arrested.
1. Stay Calm and Cooperate — But Know Your Rights
You have the right to remain silent. Only provide your name, address, and date of birth when requested. Do not answer any other questions until you’ve spoken to a solicitor.
Important: You are entitled to speak to a solicitor before and during any Garda interview. Always insist on this right.
2. Ask for a Solicitor Immediately
Tell the Gardaí you wish to speak with your solicitor — and if you don’t have one, ask for legal aid or duty solicitor access. Michael J. Staines & Company provides 24/7 legal assistance at Garda stations in Dublin.
3. You May Be Offered a Voluntary Cautioned Statement
If you are not under arrest but are asked to “give a statement,” be cautious. These statements can be used as evidence against you. Always seek legal advice before speaking.
4. Do Not Try to “Explain Yourself” Without Legal Advice
Even seemingly harmless comments can be taken out of context. Wait until your solicitor is present to discuss your situation properly and safely.
5. Understand What Happens Next
Depending on the charge, you may:
Be released without charge
Be charged and bailed to appear in the District Court
Be held overnight for a court appearance the next morning
Face more serious charges in the Circuit or Central Criminal Court
We advise and represent clients at every stage, from arrest through to trial.
